These Terms of Service ("Terms") are a legally binding agreement between you and Kales Tech LLC, a Colorado limited liability company ("Kales," "Company," "we," "us," or "our"), and govern your access to and use of the website located at https://kales.ai (the "Website") and any related products, applications, tools, software, features, and services we provide (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
If you use the Services on behalf of an entity, you represent and warrant that you have authority to bind that entity.
1. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately at support@kales.ai of any unauthorized use of your account or any breach of security.
We may suspend or terminate your account or access to the Services at any time, with or without notice, at our sole discretion.
3. User Content
3.1 Definition
You may provide inputs ("Input") and receive outputs generated by the Services ("Output"). Input and Output are collectively referred to as "User Content."
3.2 Ownership
You retain ownership of your Input. To the extent permitted by applicable law, you own Output generated for you.
3.3 License to Kales
To the maximum extent permitted by applicable law, you grant Kales a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, distribute, display, perform, create derivative works from, commercialize, and otherwise exploit User Content for any purpose, including but not limited to:
operating, maintaining, and improving the Services
developing and training artificial intelligence and machine learning models
safety, moderation, and evaluation systems
marketing, promotion, and distribution
This license is subject to applicable data protection and privacy laws.
3.4 Google Sign-In Data
Information obtained through Google Sign-In, and information derived from it, is excluded from the licenses and permissions in these Terms to train AI models, market, commercialize, or otherwise exploit User Content. That information is governed by the Google Sign-In Data section of our Privacy Policy, which takes precedence over any conflicting provision of these Terms.
3.5 Responsibility
You are solely responsible for your User Content and represent and warrant that you have all necessary rights, permissions, and consents.
4. Acceptable Use
You agree not to use the Services to:
violate any applicable law or regulation
infringe the intellectual property or other rights of any person
generate or distribute unlawful, harmful, abusive, or deceptive content
impersonate any person or entity
exploit or harm minors in any way
promote violence, hate, terrorism, or criminal activity
provide professional advice (including legal, medical, financial, or tax advice)
use Outputs for fully automated decisions affecting legal rights
interfere with or disrupt the Services
attempt to reverse engineer or extract underlying systems
You further agree not to use the Services to create, generate, upload, or distribute content that:
involves or depicts minors in any sexual or suggestive context, including any form of sexual exploitation or abuse;
involves non-consensual sexual content, including non-consensual intimate imagery or impersonation of real individuals;
is intended to harass, exploit, or harm others in a sexual manner;
violates any applicable laws or regulations related to adult or sexual content;
You are solely responsible for ensuring that any content complies with applicable laws in your jurisdiction.
We reserve the right to remove or restrict any content at our sole discretion.
5. AI Services Disclaimer
The Services use artificial intelligence systems.
You acknowledge that:
Outputs may be inaccurate, incomplete, offensive, or misleading
Outputs may not be unique
Kales does not guarantee accuracy or reliability
You are solely responsible for use of Outputs
The Services are provided for entertainment purposes only.
6. Commercial Use
You may use Output for commercial purposes. However:
Kales does not guarantee exclusivity
Kales is not responsible for third-party claims
7. Intellectual Property
All rights in the Services, including software, models, and technology, are owned by Kales or its licensors.
No rights are granted except as expressly stated.
8. Third-Party Services
The Services may include third-party content or integrations. Kales is not responsible for such services.
9. Privacy
Your use of the Services is subject to our Privacy Policy.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
KALES' TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE TOTAL FEES PAID BY YOU TO KALES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless Kales from any claims arising from your use of the Services.
13. Dispute Resolution and Arbitration
Any disputes shall be resolved through binding arbitration on an individual basis.

class actions
You may opt out by emailing support@kales.ai within 30 days.
14. Governing Law
These Terms are governed by the laws of the State of Colorado, to the extent permitted by applicable law.
15. Termination
We may suspend or terminate access to the Services at any time, with or without notice.
16. Copyright and Intellectual Property Complaints
Kales respects intellectual property rights.
If you believe content infringes your rights, you may submit a notice to:

We may remove content and terminate repeat infringers.
